Head of Inspection Board Calls on Personal Status Judges

Sana'a: The head of the Judicial Inspection Board, Judge Dr. Marwan Al-Mahqari, called on all personal status judges when considering partition requests to conduct forced partition and include its procedures in their rulings. The head of the board emphasized that, based on the provisions of forced partition stipulated in the Civil Code, a judge must conduct forced partition when considering a partition request and include it in his ruling, rather than simply ruling to conduct the partition, as is the practice in many cases.

According to Yemen News Agency, the directive from Judge Dr. Marwan Al-Mahqari aims to ensure that the procedures outlined in the Civil Code are strictly adhered to by personal status judges. The insistence on including forced partition in rulings, rather than merely ordering it, seeks to bring clarity and uniformity to the judicial process related to partition cases.
