Specialized Criminal Court Reviews Jurisdiction in Murder and Bombing Case

Al-Dhale':The Specialized Criminal Court, led by Judge Abdullah Al-Hamzi, reviewed the Public Prosecution's response to defense pleas questioning its jurisdiction over a case involving an armed gang accused of murder, arson, and bombing in the capital and Al-Dhale'.

According to Yemen News Agency, Prosecutor Judge Mujahid Al-Shabibi stated that the charges, which include involvement in an armed gang attacking citizens and threatening public security, fall under crimes against state security and public safety. These charges are within the jurisdiction of specialized criminal courts, as per the applicable laws.

The prosecution detailed that the indictment involves organized criminal activity characterized by planning, coordination, division of roles, and the use of weapons to attack houses and property. This activity resulted in the death of Amah Al-Rahman Al-Omari, an attempted murder, and property damage.

In their response, the prosecution dismissed the defendants' jurisdictional challenges, asserting that issues regarding the sufficiency of evidence or the attribution of the alleged acts should be addressed by the court during the ruling on the case.

Further, the prosecution argued that previous rulings on insufficient evidence were provisional and did not preclude renewed investigations or prosecutions if new evidence or legal grounds arise. They concluded that the court possesses both subject-matter and territorial jurisdiction, urging the rejection of defense pleas and the continuation of the trial.

The court allowed the defense the opportunity to respond to the prosecution at the next hearing. Additionally, the private claimants announced their intention to join the Public Prosecution in the case.
